About these terms

These terms apply when you purchase or use a paid service from Calan Williams trading as CW Driver Development. The service description, price and any written arrangements agreed for your booking also form part of the agreement. If an individually agreed written term conflicts with this page, the individually agreed term takes priority for that booking.

Nothing in these terms excludes or limits rights that cannot lawfully be excluded under applicable consumer law.

Eligibility and junior drivers

You must provide accurate information and have authority to enter into the agreement. If the driver is under 18, a parent or legal guardian must make and manage the booking or membership, accept these terms, provide any required consent and remain responsible for the young person’s supervision and welfare outside the coaching itself.

Junior Academy members may use Patreon and Discord only when they meet each platform’s minimum age requirements. Where a junior is too young to use Discord, their parent or guardian may use the Academy Discord on their behalf.

Prices and payment

Prices shown on the relevant service page, RaceBook, Calendly or Patreon apply when the order is placed unless another price is agreed in writing. Third-party platforms may display local-currency conversions, taxes or platform charges before payment.

You are responsible for ensuring that payment details are valid. Access to a paid service or membership may be suspended when payment fails or is reversed.

Remote simulator coaching

Remote simulator coaching is delivered one to one on PC through Discord. You need compatible simulation software, working Discord audio, a suitable microphone and a stable internet connection. Console sessions are not currently supported. Sessions normally focus on one car and one circuit, although reasonable adjustments may be agreed.

With at least 24 hours’ notice, you may choose a refund or a rescheduled session. Requests made with less notice are considered case by case, with best endeavours made to find another suitable time. If you do not attend and give no notice, the session is non-refundable and cannot be rescheduled, except where the law requires otherwise.

Technical problems are considered case by case. Reasonable efforts will be made to preserve the expected value of the session, but you remain responsible for your own equipment, software, connection and simulator accounts.

Lap and telemetry reviews

A Replay Analysis reviews the submitted replay or video. A Replay and Telemetry Analysis also reviews compatible telemetry. These private, individually purchased reviews are paid for and submitted through RaceBook. Native replay or telemetry files from iRacing, Assetto Corsa Competizione and Le Mans Ultimate are accepted, together with common video formats and other formats confirmed as suitable. RaceBook’s current upload restrictions apply at submission, and private paid reviews require files that RaceBook accepts.

You may submit a full session. For practice or qualifying, the fastest lap will normally be reviewed. For a race submission, the review will normally focus on racecraft unless another reasonable focus is requested.

Once payment and the required files have been submitted, the order cannot be cancelled except where required by law. If the supplied file is unreadable, incompatible or the wrong type and a review cannot reasonably be completed, you will receive a full refund.

Completed reviews are normally delivered as unlisted YouTube videos with a short written summary. Anyone with an unlisted link can view it. Source replay, video and telemetry files are removed as soon as practical after completion.

On-track support

On-track support costs £495 per coaching day, plus agreed travel, accommodation and other reasonable expenses. International bookings also include £150 for each travel day. A coaching day covers the event’s scheduled running time plus review work completed afterwards.

A £150 deposit per coaching day secures the agreed date or dates. The remaining balance is invoiced after the event and must be paid within 14 days of the invoice date. The client arranges and pays for circuit access, passes and event credentials.

With at least 30 days’ notice, you may reschedule once or receive a refund less agreed non-refundable expenses already incurred. With less notice, requests are considered case by case. Any amount retained will be limited to agreed unrecoverable expenses and genuine net loss remaining after reasonable steps to reduce that loss. A no-show is non-refundable only to the extent of genuine unrecoverable loss.

If CW Driver Development cancels, you may choose a full refund of payments made to CW Driver Development or an agreed replacement date. If weather, the venue or an organiser causes cancellation or postponement, rescheduling will be offered first. If no suitable date can be arranged, payments made to CW Driver Development will be refunded less agreed expenses that cannot reasonably be recovered.

CW Driver Academy membership

Academy membership is available worldwide wherever Patreon is supported, subject to applicable local restrictions. Membership is purchased and managed through Patreon. One membership tier is available at launch. The first 20 founding members may join at £15 per month and retain that rate for the original launch tier while their membership remains continuous. If a founding member cancels and later rejoins, the founding rate no longer applies. The standard price for that tier is £29 per month. Additional higher tiers may be introduced in the future and will be priced separately.

Membership is monthly only. No annual plan or free trial is offered. Patreon charges members when they join and renews the subscription automatically each month on the subscription date until cancelled. You may cancel at any time and retain access until the end of the paid billing period. Refund requests are handled under Patreon’s current refund policy and applicable consumer law.

Active membership includes pre-recorded courses, live workshops, live lap-review sessions, weekly lap-time challenges and the private Academy Discord. The Academy launches with Driving Fundamentals and intends to release a new pre-recorded module each week. Live workshops and lap-review sessions are planned at an average combined frequency of three each month, with additional sessions where time allows.

Academy live lap-review submissions are made through the private Academy Discord, not through RaceBook. They are a membership benefit and are separate from private, individually purchased reviews. Time limits mean only a selection can be reviewed. Selection is based on relevance to the current topic and usefulness as a learning and discussion example, so submission does not guarantee review.

Each lap-time challenge will publish its car, circuit, dates, eligibility, method and confirmed prize before it begins. The fastest eligible driver under the published rules wins. There is no random-participant prize.

Calan communicates regularly in Discord and answers questions when practical, but no response to every question or within a fixed time is guaranteed. Members must behave respectfully and follow applicable Patreon and Discord rules. Access may be restricted where reasonably necessary to protect the community or respond to serious or repeated misconduct, subject to applicable consumer law.

Recordings and member contributions

Live Academy sessions may be recorded for the active-member library. Recordings are intended to remain available indefinitely while the Academy and its hosting platforms continue to operate. Reasonable steps will be taken to remove or obscure identifying usernames, voices and personal details in recordings and submitted footage, but complete anonymity cannot be guaranteed.

You confirm that you have the right to submit any replay, telemetry, video, image, message or other material you provide. You grant CW Driver Development permission to use submitted material only as reasonably needed to deliver the requested service or Academy activity, subject to the privacy notice and any separately agreed permission for public use.

Intellectual property and permitted use

Courses, recordings, written feedback, circuit notes, diagrams, videos and other materials supplied by CW Driver Development remain the intellectual property of their respective owner. They are licensed to the client or active member for personal, non-commercial use only.

You must not republish, redistribute, resell, publicly share, reproduce for others or share account access to those materials without prior written permission. This does not prevent fair use that the law expressly permits.

Coaching outcomes and safety

Coaching and educational content are intended to develop understanding and decision making. No particular lap-time improvement, race result, career outcome or competition result is guaranteed. Services will be provided with reasonable care and skill.

Motorsport and simulation equipment involve inherent risks. You remain responsible for following venue, organiser, team and equipment rules, making safe decisions and ensuring that you and your vehicle or simulator are suitable for the activity.

Availability and events outside reasonable control

Reasonable efforts will be made to deliver services as described. Schedules, speakers, platforms and individual Academy activities may need to change because of illness, racing commitments, platform outages, venue decisions, safety issues or other circumstances outside reasonable control. Where a material paid service cannot be delivered, an appropriate replacement, reschedule or refund will be offered as required by law and the relevant service terms.

Liability

Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, breach of statutory consumer rights or any other liability that cannot legally be excluded.

Subject to that protection, CW Driver Development is not responsible for losses that were not reasonably foreseeable when the agreement was made, losses caused by your equipment, software, connection, venue, organiser or third-party platform, or business losses arising from a consumer purchase.

Privacy

Personal information is handled as explained in the privacy notice. Patreon, Discord, RaceBook, YouTube and other external platforms also apply their own terms and privacy information when you use them.

Complaints

If something is wrong, email calan@cwdriverdev.com with your booking or membership details and a clear description of the issue. CW Driver Development will review the matter and aim to provide a fair response within a reasonable time.

Changes to these terms

The terms that apply to a one-off service are those accepted when that service is purchased, together with any later change agreed with you. These published terms may be updated for future purchases or to reflect changes in law, platforms or services. Material changes affecting an active recurring membership will be communicated in advance where required.

Governing law

These terms are governed by the law of England and Wales. The courts of England and Wales have jurisdiction, although consumers living elsewhere retain any mandatory protections and rights to use local courts that applicable law gives them.
